Privilege review is one of the most time consuming and expensive parts of any review project. It’s also one of the most sensitive and important parts of it as well. The costs of human reviewers missing privilege can be harsh, with client sensitive data made public and the need for a series of necessary clawback motions to prevent further disclosure. And whereas TAR has cut down on the number of documents for relevance, it has never been particularly practical when it comes to Privilege reviews. This is where generative AI can be extremely helpful to the review process.
eDiscovery AI has created a Privilege Review feature that helps improve the Privilege review process considerably. All with a few mouse clicks. Simply access the eDiscovery AI application, select the “Privilege” job type and “Privilege” tab, and enter the necessary information. You can use the standard Attorney-Client and Work Product prompts or create your own custom ones. Copy your privileged attorney list and enter in your “safe domains” (which would identify the scope of internal or confidential communications) into the respective fields, along with map the necessary outputs to the various fields and click “OK.”
Within minutes the results will return and you can review and consider the information. You get the Privilege Call, the Privilege Type, the hits from the Attorney List, the various privilege elements evident in the document, and a Privilege Log Entry. All of these fields are exportable for you to include into a prospective Privilege Log. In addition, documents containing Attorney names but no other elements of privilege (for instance, if there was a potential break in confidentiality or it was not pertaining to legal advice) are flagged as “Potentially Privileged,” so you can take a closer look and make a more direct determination.
Eliminating the need to manually review tens of thousands of documents to specifically target the ones you need saves considerable amounts of time and vast sums of money. Results can be searched, confirmed or revised, and dispensed quickly and easily. The slow, tedious, cumbersome work of composing and compiling a privilege log is minimized. In addition, as another use of eDiscovery AI’s privilege review tool, applying the eDiscoveryAI application against potential production sets can quickly identify and prevent potential privileged material from erroneous production, and can be done in little time, ensuring a quality production.
